Can Foreigners Buy Property in Bingin

No, not as Hak Milik. Foreigners cannot hold Indonesia's freehold title on this cliff or anywhere else in the country, under UUPA Article 26(2). Three routes remain open instead: Hak Sewa leasehold, Hak Pakai with a valid stay permit, or land held through a PT PMA company on HGB.

Freehold Never Reaches A Foreign Buyer

Hak Milik sits at the top of Indonesia's land-title system, and it is reserved for Indonesian citizens by law. A foreign passport or a foreign-owned company cannot hold it, full stop, regardless of how the purchase is structured or how long the buyer has lived here.

Hak Sewa Dominates Bingin's Own Stock

Bali Exception's sample of Bingin listings shows leasehold running the show. One and two-bedroom villas on this cliff are dominated by Hak Sewa arrangements, with freehold apartments and penthouses appearing far less often. Unlike a title, a lease of this kind never touches BPN's land register, so your protection sits entirely inside the contract itself:

  • A notary or PPAT drafts and confirms the lease, usually with witnesses present.
  • No public search can confirm a Hak Sewa lease exists, since it is a private agreement.
  • What happens at expiry is whatever the two parties wrote into the contract.

Hak Pakai Needs A Visa And Price Floor

Hak Pakai works differently: it needs a stay permit first. Hold a valid KITAS or KITAP and the property clears Bali Province's regulated price floor, and Hak Pakai becomes available to you as a genuine right of use. It suits someone planning to actually live here long enough to carry that permit, not an offshore investor buying sight unseen.

A PT PMA Can Hold The Land Company-Side

The fourth route swaps a person for a company. Set up a PT PMA, a foreign-invested Indonesian legal entity, and it can take on HGB or Hak Pakai, even land that was Hak Milik under the seller right up until the sale converts it. The company can never hold Hak Milik in its own right, but this is the structure most villa-rental operations here actually use at scale.

Why The Nominee Shortcut Fails

An agent might suggest listing an Indonesian citizen as the certificate holder while you quietly pay for and control the property. Three separate legal barriers close that door:

  • UUPA Article 26(2) blocks a foreigner from acquiring land ownership outright or through any indirect workaround.
  • SEMA 10/2020 tells Indonesian courts to treat a nominee agreement like this as void from the start.
  • Perda Provinsi Bali Nomor 4 Tahun 2026 adds a province-wide ban on moving land ownership through a nominee, on top of the national rules above.

Courts have already voided deals built this way, and the underlying land can end up reverting to the state. Whatever an agent promises, a nominee structure buys you no safety at all.

This Cliff Makes The Stakes Sharper

Badung Regency asserts ownership over much of Bingin's cliff and beach frontage. Officials tore down 48 buildings on that ground on 21 July 2025, citing missing permits on land the regency claims as its own. Getting your tenure structure right matters everywhere in Bali, but it matters more on a stretch of coast where the underlying land status itself is already in dispute:
