It never touches BPN, Indonesia's land registry, which means there is no public record showing when a specific lease started, how long it runs, or who currently holds it. If you buy a leasehold villa here secondhand, the notarised contract itself is the only document that can answer those questions.
The Contract Decides The Building's Fate
Every guide on this point agrees: Indonesian law fixes no single default outcome for a building still standing once a lease ends. Whether you get compensation, a buy-back offer, or simply have to remove the structure depends entirely on what the original contract specifies. That makes the drafting stage, not the expiry date, the moment that actually protects you:
- Ask for a buy-back or compensation clause to be written in before you sign, not assumed later.
- Confirm whether removal costs fall on you or the landowner if no renewal is agreed.
- Get any verbal promise from the landowner put into the document itself.
Extension Only Works If You Wrote It In
Nothing about a Hak Sewa term renews on its own. If the original contract includes an extension clause, you can usually exercise it on the terms already agreed. A villa sold with 20 years left on its original 30-year Hak Sewa term is a different asset from the one the first buyer signed for, even if nothing about the building has changed. Ask for the lease's start date and original term in writing, then work out the years remaining yourself rather than trusting a listing's description.
